1. Scope
These terms apply to quotations, orders and deliveries of die castings, tooling and related services supplied by SUNGREAT. Terms proposed by the buyer that conflict with these are not binding unless we accept them in writing.
2. Quotations
Quotations are valid for 30 days unless stated otherwise. Prices are based on the alloy, volume, tolerance and finish stated in the enquiry. A change to any of these may require a revised price.
3. Tooling
Unless agreed otherwise, tooling remains the property of SUNGREAT until fully paid, at which point ownership transfers to the buyer. Tooling is maintained free of charge for the production life stated in the quotation, provided the buyer orders within the agreed volumes.
4. Orders and Delivery
Lead times are counted from receipt of a written purchase order, approved samples and any required deposit. Stated dates are estimates made in good faith; we will notify you immediately if a date is at risk.
5. Inspection and Claims
The buyer should inspect goods on arrival and notify us of any visible defect within 15 days of delivery. Claims for latent defects must be raised within the warranty period stated in the order confirmation.
6. Warranty
We warrant that goods conform to the agreed specification and are free from defects in material and workmanship. Our obligation is limited to repair, replacement or credit at our option.
7. Limitation of Liability
Our liability for any claim is limited to the value of the goods giving rise to the claim. We are not liable for indirect or consequential loss, including lost production or lost profit.
8. Governing Law
These terms are governed by the laws of the People’s Republic of China. Disputes shall first be resolved by negotiation, and failing that by arbitration in [city].
